STREAM OBSERVATORY

The Observatory provides a database presenting the most relevant and latest national case law dealing with the European Arrest Warrant (EAW) in selected EU Member States, as well as those issued by the Court of Justice of the European Union (CJEU) covering all EU Member States.

In light of the STREAM Project Objectives, the national and European Case Law pay particular attention to key issues and interpretative questions in court proceedings related to the relationship between mutual trust, mutual recognition, fundamental rights and the rule of law in the implementation of the EAW.

The Observatory includes two Search Options – one related to national Case Law and another on European judgements – for end users to select Case Law in relation to specific Member States/Country and/or Key Word/Topics.

Key National cases: The national case law component provides a detailed and updated overview of the most relevant national judgments covering the EAW, paying particular attention to those related to the STREAM Project objectives and themes.

It covers an in-depth overview of the Case Law in 14 EU Member States which have been subject to investigation and comparative assessment in the scope of the STREAM Project (See: Country Reports and Comparative Report). The Observatory provides Headnotes in English of the Cases.

Key EU cases: The European case law component of the Observatory offers end users the possibility for searching – by Keyword and all EU Member States – the relevant and most recent CJEU Case Law dealing with EAW.

Key National cases

This section provides a selection of national case law. It allows users to search for key cases related to the use of the EAW in each of the 14 Member States covered by STREAM national-level research.

The tool allows the user to search by country and it incorporates the possibility to add thematic keywords to further fine-tune the search. The filtering is restrictive, which means that the results only display those cases that have the selected keywords allocated to them. The more keywords the users select, the most accurate the search is. When selecting a country, only the keywords allocated to that country appear in the cascade menu. The cases provide the full name and European references (ECLI numbers, if available) as well as headnotes in English.

Key EU cases

This section provides a selection of Decisions by the Court of Justice of the European Union related to rules and standards governing the use of the EAW. 

The tool allows the user to first select by keyword. The selection of one keyword is mandatory. If more keywords are included, the search is more restrictive. A second selection lets the user add a Country. If no country selected, the results are displayed and ordered by country concerned or EU in case of general decisions.
